1 This is a review of a published decision of the court of appeals reversing a judgment of conviction and an order denying post-conviction relief of the Circuit Court for La Crosse County, Michael Kirchman, Judge. The judgment and order stem from a fourth trial in which Richard Moeck, the defendant, was convicted of two counts of first degree sexual assault, one count of false imprisonment, one count of robbery, and one count of intimidation of a victim. In denying the defendants motion for post-conviction relief, the circuit court concluded that the defendants fourth trial following a mistrial in the third trial did not violate double jeopardy protections.
